When A Tax Which Is Not A Tax Is A Tax

Obama promised that he wouldn’t raise taxes on anyone below $250K income. Then he argued that Obamacare was constitutional, because it was a tax on everyone. This was after he said that Obamacare was not a tax.

In the last two days we have seen two federal court rulings showing that the judicial branch has relinquished its responsibility – in deference to dear leader.

    We are constantly lectured by the establishment media that conservatives ‘won’t’ compromise. Yet the same establishment media warns its audience that there are five conservative justices on the SCOTUS.
    Only in bizzaro world….

  2. johnmcguire says:

    Well I wonder what they have on that scumbag Roberts. This opens the door, is the last straw whatever you want to call it . Now the revolts will begin.

  3. Andy DC says:

    The Supreme Court has basically unlimited power. If Obama wins re-election and gets a chance to appoint a couple more justices, it will only get much worse.

  4. johnmcguire says:

    Anyone , even a democrat knows that this is not a tax as there are private companies that make their living on the selling of insurance. I think the insurance companies are some of the richest in the world. So , it is just one lie after another coming from the mouths of the communists. Old Kruchiv knew what he was talking about that day he banged his shoe on the table in front of John Kennedy and said America would lose to communism. What a pathetic mess this once proud nation is in. We are led by liars fakes and crooks. We don’t even know where our scumbag president was born.

  5. Eric Simpson says:

    My comment also on hotair: Looks like we already have a de facto liberal supreme court, with the ruling overturning much of the AZ immigration law, and now this. THIS!
    They say if O wins reelection, we’re going to be tyranized by a liberal supreme court for a generation. No doubt. Basically, what that would mean is that the future scotus would ok any and all leftist socialist schemes and power grabs. Wealth Taxes (as 5% yearly tax on net worth), outright govt takeover of many industries (including all of medicine, making medical care a nightmare), affirmed Affirmative Action but also “Affirmative RE-Action” penalizing whites specifically (as lib whites will join the others in legislating this), and intrusive Gay Affirmative Reaction, govt expropriations of huge tracts of rural (and urban) land in service of Agenda 21, cap & trade with effective de-industrialization.
    A liberal supreme court for a generation if O wins. We have 4 months left until the election. We all need to put all aside and donate our time and money to this once in a lifetime fight. And we need to get as many R senators as we can. Look at the senate races and see what we can do to win them all.

    I swore in 1996 I wouldn’t vote for another establishment Republican. I voted for Dole because “he’s better than the other guy”. Then I succumbed to the “imagine the alternative, Al Gore”. So I voted for Bush in 2000, Then it was “oh how horrible to consider John Kerry being president”, so after being sucked in by those assuring me I must vote for the lesser of two evils and not throw away my vote, I didn’t follow my conscience and voted for Bush again. We were told how great Justice Roberts was, a true follower of the Constitution in its original intent by the founders. Ha!

    In 2008, McCain was the last straw. NO WAY was I going to vote for that Progressive spaghetti spine moderate. Ah, but then he brought in Sarah Palin so I thought 1/2 of the ticket I mostly agree with is better than none. The housing crash sealed McCain’s fate, but I thought hopefully Americans still wouldn’t elect a Communist over even a moron like McCain……

    It is 2012, and we have the inspiration for Obamacare running on the GOP ticket, who liked government run healthcare before he didn’t like it. He claims he is a Conservative. I don’t know about others, but I’m sick of them all. As much as I disagree with Ron Paul on foreign policy issues, he is right on when it comes to fiscal matters and the role of government. What should I do, hold my nose again in hopes of yet another mealy mouth “moderate” Republican will shrink government and repeal Obamacare only to be disappointed again? Personally, I think there is no hope in turning “things” around, and am planning accordingly. What does that mean? Total economic collapse and a dimmer future for my kids.

    Why don’t I think “things” can be turned around?
    “A democracy is always temporary in nature; it simply cannot exist as a permanent form of government. A democracy will continue to exist up until the time that voters discover that they can vote themselves generous gifts from the public treasury. From that moment on, the majority always votes for the candidates who promise the most benefits from the public treasury, with the result that every democracy will finally collapse due to loose fiscal policy, which is always followed by a dictatorship.

    The average age of the worlds greatest civilizations from the beginning of history, has been about 200 years. During those 200 years, these nations always progressed through the following sequence:

    From bondage to spiritual faith;
    From spiritual faith to great courage;
    From courage to liberty;
    From liberty to abundance;
    From abundance to complacency;
    From complacency to apathy;
    From apathy to dependence;
    From dependence back into bondage.” true author unknown

    Now we have a SCUTUS that has literally given the government limitless power, in particular Barack Obama for at least 5 more months, effectively the license to control every aspect of our lives by simply calling their actions a tax or relegating authority to the EPA et al. The government will be able to tax behavior now; it will be able to force Americans to do anything it wishes. The Constitution, what was left of it, has been burned up with one match. There really is nothing limiting what the government can do now. This was Obama’s dream as he disliked the Constitution because it says what the government cannot do. It has been rewritten by men/women in black robes.

    What a surprise at least 1/2 of Americans will have beginning in 2013 and the year after when they will see their incomes evaporate as the biggest tax increase in world history, and the biggest power grab by the Federal Government in American history will take affect. Oh, and those of you who think your healthcare plan you may like now is safe as King Obama has promised, you will be in shock one year from now.

    If there was any question which direction the country is going, or what the economy will do in the coming months/years, there is no question now.

    RIP America.

  7. By this action, our government has lost all claim to allegiance. It has clearly stated that we are all owned by the state to be used, abused, and discarded at whim. Reason, reality, and logic will determine the outcome. The path to the end will not be peaceful nor pretty.

    He who is free never submits. He who submits was never free. Stay free!

  8. John B., M.D. says:

    President Obama will now blame Chief Justice Roberts, an unelected official, for raising taxes.

    There is now no incentive for Democrats and their trial lawyer buddies to pass any tort reform, allow selling of health ins across state lines, or make any other improvements the GOP wants. The GOP now has no bargaining chips.

    Children can stay on their parents’ health ins until age 26 = parents are now required to pay their childrens’ health ins premiums if the children do not purchase coverage on their own.

    Gone is my cheap high-deductible health plan. I will now subsidize the medical care of fat smoking drinking drug-abusing noncompliant couch potatoes.

    The text of the SCOTUS PPACA ruling:

    https://s3.amazonaws.com/sermo-assets/production/post_attachments/15699/original/SCOTUS_decision.pdf?1340896239

    Page 12:

    “Members of this Court are vested with the authority to interpret the law; we possess neither the expertise northe prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences oftheir political choices.”

  10. gofer says:

    54% want the law repealed and this has remained constant over 2 years. 82% want choices of high cost, low deductible or low cost, high deductible plans. These choices are gone under Obamacare. 77% rate their plans good or excellent while only 3% say the opposite. It cannot stand, no matter what because millions are going to be very unhappy when they lose their insurance or start paying a 40% excise tax.

    Those vocally agreeing with the plan will have 2nd thoughts when the details start emerging. It’s not pretty. The other problem is what about the states like Ohio, who have voted to NOT participate?? It’s coming to the time, when people are just going to say, “We won’t play anymore.”

  11. leftinbrooklyn says:

    No worries, Obamacare won’t be long-lived. It will collapse under the weight of it’s own debt much faster than the rate at which even the current entitlements are collapsing. I’ve got probably around 20yrs left, & I bet I see it’s death.

    Now, what state it leads us to before it’s demise, that is disconcerting.

    The EU will soon dissolve over debt issues. I won’t be shocked when US states begin breaking away…

  12. Paul in Sweden says:

    ObamaCare cannot exist without Obama. I am not too worried. November is around the corner.

  13. David says:

    The deeper the pain, the deeper the lessson. If the USA survives this, we may actualy remember our roots in freedom. The sun will rise again, but I am afraid it is just now setting. )-;

  14. kim2ooo says:

    Albeit: I agree with the article AND comments here, I must also laugh.

    Why? says you

    Well…says I
    This has been defined as a tax.

    So? says you

    Well…says I
    Remember all those back-room deals and passes / waivers given by the Obama team?

    Yes but Why? says you

    Well…says I
    Can those unions that received waivers be exempt from a tax? Can government workers be exempt from this tax and how about members of congress?

    So? says you

    Well…says I

    The President can’t give tax exemptions – unless those organizations ARE TAX EXEMPT.
