The lawyer representing David Epstein, the Columbia professor accused of sleeping with his daughter, recently spoke out about his client’s controversial case.
Epstein was charged last week with one-count of third-degree incest for what was allegedly a consensual three-year sexual relationship with his 24-year-old daughter.
Epstein’s lawyer, Matthew Galluzzo, gave comment to ABCNews.com:
“Academically, we are obviously all morally opposed to incest and rightfully so,” Galluzzo said. “At the same time, there is an argument to be made in the Swiss case to let go what goes on privately in bedrooms.”
“It’s OK for homosexuals to do whatever they want in their own home,” he said. “How is this so different? We have to figure out why some behavior is tolerated and some is not.”

Though this makes one feel like puking, it is a little more common than people know. I think the statistics show that there are more men that want to marry their daughters than there are gay men that want to marry a man.
But I still feel like puking.
But back to the point of the post, I guess morality is a relative to some people. It’s easy to say others aren’t moral but you are. It’s different when it’s you for some. In this case maybe his finding ‘morality’ to use against ‘skeptics’ was a case of projection.
We are all going to die! And it’s all the fault of straight, white males who drive pickups, beat their wives and vote Republican.
It can all be justified because it is tough getting more than 2 kegs in a car so a fella needs a pickumup truk.

Its called societal benefit. Morality laws weren’t invented by some Bible thumping republican. The lawyer even referenced homosexuality. While both are no-no’s in the Book, one can easily look to other societies and see both are no-no’s without the guidance of the Bible. Why? In both cases, there is easily seen a harm to society if such behavior was frequently engaged.
First, reproduction. Every organism must reproduce to remain. The genetics must have a positive movement. And disease cannot be very prevalent.
Personally, I couldn’t care less about what a person does to get their rocks off. (Although, I’m fairly repulsed by the implications of the above story.) But there is a societal need that requires proper mating habits for our species to remain viable.
To recap, if most engage in incest our species dies. If most engage in homosexuality, our species dies.
To understand where Epstein’s lawyer is coming from, you need to be familiar with the Supreme Court’s decision on Lawrence v Texas, which struck down some Texas anti-sodomy statutes as unconstitutional. The majority decision in Lawrence basically said that sex between consenting adults is protected under the constitution’s unwritten right to privacy and government attempts to regulate private sexual behavior are therefore unconstitutional.
Using Lawrence as a precedent, a sympathetic judge could easily find New York’s anti-adult incest law unconstitutional.

If this was some “denialist” tell me this wouldn’t be front page liberal media news and the subject of innumerable editorials.
All I am going to say about this is, I remember people said gay marriage was a slipperly slope, well here this lawyer is doing just that. Using the “if it’s okay for them why not us?” argument. It is a slippery slope and it will continue to open up more sickness as accepted behavior. If not this case, some judge somehwere else.
I think the difference is that scientists can provide data to show that incest leads to more mental illness among participants and any children created from incestuous relationships are more likely to have serious genetic diseases and deformities. Throughout history, incest has led to some seriously deformed royals (think Charles II of Spain who had both physical and mental handicaps and such severe prognathism that he could not chew). So the likely of incest becoming mainstream is much less likely than homosexuality simply because we can prove more serious consequences than just moral ones.
But how long before it becomes legalized with the stipulation that all conceived babies from the union must be aborted? Solves the “problem” you mention above.

This isn’t about what I think. It’s about what a judge will think.
I’m not passing judgment on homosexuality at all, one way or another. I personally do not agree with homosexuality in my own life, but that’s no one else’s business, and I don’t intend to make it their business.
I’m simply saying that there are more tangible consequences (beyond AIDS, of course) to incest than there are to homosexuality, and therefore it is less likely for a judge to deem it constitutionally acceptable.
And you’re right, scientists can provide data that “prove” just about anything. But a judge has to take a scientist for their word and ignore any possible bias or hidden agenda of the scientist because the judge can’t do the scientist’s job any better than the scientist.
Again, it’s not about what you or I think or even what’s right. It’s about the interpretation of a single judge (ignoring the appeals process), and you have to consider what impacts the judge the most, which is scientific and historical data. I’m sorry if you don’t like it, but that’s the way it works.

This statement “if most engage in homosexuality our species will die”. Is that supposed to mean that most people are latent homosexuals? That if homosexuality is tolerated, most people would not have an attraction to women? That is totally absurd and homophobic.
I don’t think that’s what it meant. What it means is simple and straightforward – if the majority of the population were homosexuals, they would not reproduce and the species would die out. You could say the same thing about nuns.
In reality, it probably wouldn’t work because the minority would still reproduce…so there would still be a population.

Unfortunately, that same statement has been repeatedly spewed by bigots over the years in their quest to keep gays a persecuted underclass and keep homophobic sanctions and statutes in place.
I’m not saying that the person who posted the remark is a bigot, and he is no doubt a good person, but I’ve heard many so many bigots make that statement over the years that I felt I needed to respond.
Most people are straight and the species would never die even if homosexuality was glorified (as in ancient Greece), so why make the statement to begin with? The only reason is to make it sound like homosexuals are “unnatural” and a menace to society.
“Homophobia” is Jew-speak.
