The Straw That Broke The Camel’s Back

Sea level has risen 120,000 mm in Florida since the last ice age, but Barack Obama believes the last 100 mm have somehow wrecked the Everglades.

    • If in can happen in Wisconsin….
I would encourage everybody to read this piece and become informed… Scott Walker supporters targeted by a partisan prosecutor who directed the POLICE to bust into homes… to seize computers and cell phones without a Warrant!! Folks were told they could not have a Lawyer and to NOT speak of the Police Home Invasion…

This is what Progressives do folks… little Stalins… They did it to Walker Supporters, they co-opted the IRS against the Tea Party… they took over the Wisconsin Capitol for a week after LOSING an election… they illegally took over city parks across the Nation with OWS…

No no, read closely, the cops DID have a warrant. Seems Judge Barbara Kluka was in the rubber stamp business, keeping all the paperwork up to date. Who knows, maybe what they did was even legal, by the letter of the law. Certainly none of them were upholding the oaths of their office.

Very bad for law and order that sort of thing, cops should refuse but they generally don’t. Hopefully the guilty will be punished, let them know about consequences of thuggery. At any rate at least we know what unionists and communists are willing to do.

      • Gail Combs says:

….O’Keefe and the Wisconsin Club for Growth followed up Judge Peterson’s ruling by filing a federal lawsuit against Chisholm and a number of additional defendants, alleging multiple constitutional violations, including a claim that the investigation constituted unlawful retaliation against the plaintiffs for the exercise of their First Amendment rights. United States District Court judge Rudolph Randa promptly granted the plaintiffs’ motion for a preliminary injunction, declaring that “the Defendants must cease all activities related to the investigation, return all property seized in the investigation from any individual or organization, and permanently destroy all copies of information and other materials obtained through the investigation.”

From that point forward, the case proceeded on parallel state and federal tracks. At the federal level, the Seventh Circuit Court of Appeals reversed Judge Randa’s order. Declining to consider the case on the merits, the appeals court found the lawsuit barred by the federal Anti-Injunction Act, which prohibits federal courts from issuing injunctions against some state-court proceedings. O’Keefe and the Wisconsin Club for Growth have petitioned the Supreme Court for a writ of certiorari and expect a ruling in a matter of weeks.

Worth looking at WIKI on writ of certiorari. The Supreme Court only hears about 1% of cases brought to it’s attention.

Als worth looking at ,The Exceptions to the Anti-Injunction Act: A Federal Injunction May Be the Shortest Route to Success in a State-Court Suit by Craig W. Canetti, Mayer Brown LLP

        Introduction
….specifically, the federal Anti-Injunction Act (AIA), 28 U.S.C. § 2283, includes three exceptions that empower a federal court to enjoin a state proceeding when necessary to give full effect to a federal right or remedy, or to protect or preserve the federal court’s exercise of its jurisdiction or a prior federal judgment. What is more, because these exceptions are intended to preserve the effectiveness of federal law and the authority of the federal courts—not to protect the purely private interests of the party that seeks the injunction—the AIA and the cases applying it impose few requirements for seeking an injunction, other than that it must fall clearly within one of the statutory exceptions….

        THE COLOR OF THE LAW
What was done was an illegal act under the color of law and even the police officers are not immune. Here’s the pertinent Federal statute.

USC Title 18 Part 1 Chapter 13 § 242 – Deprivation of rights under color of law

        Summary:

Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. For the purpose of Section 242, acts under “color of law” include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official’s lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.

The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

        TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, … shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnaping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

        ·         “Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.”   Miranda vs. Arizona, 384 US 436 p. 491.

The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it:

        Unconstitutional Official Acts

        16 Am Jur 2d, Sec 177 late 2d, Sec 256:

The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land….. This is succinctly stated as follows:

The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it’s enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it…..

A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby. [NORTON v. SHELBY COUNTY, 118 U.S. 425 (1886)]

Florida is rich in phosphate deposits, because the state used to be below sea level. Shark fossils are not uncommon in the middle of the state. Which shows how much things naturally change.

    • rah says:

Yep! I put plenty of abrasion resistant ceramic in various applications at those processing plants. Really is quite an operation the way they transport the stuff in a slurry from where the gigantic drag lines dig it up and then process it. Megalodon teeth are not an unusual find among other fossils. Abrasive stuff.

Another interesting thing mined in Florida is Titanium Dioxide as in the white paint pigment. Also diatomaceous earth. Designed applications and sold them to all of those mining and processing operations down there.

    • Yep, the whole state of Florida used to be a swampy mess… until Mankind came along and lowered Sea Level.. cooled things down…

Now we need to warm it back up and return Florida to the swampy bog is used to be thousands of years ago BEFORE Mankind..

Wonder what the Everglades looked like 4-6K years ago when the oceans were six feet higher.

  3. SMS says:

They’ve been draining the Florida swamps for over 200 years and now they want to put all the water back where it was originally. They might find that the sea level drops when they put all the water back, especially back into our depleted aquifers.

    • Gail Combs says:

Draining swamps (and spraying with DDT) was done to get rid of diseases like malaria back when I was a kid. Now the EPA screams bloody-murder if you fill in the mud puddles in your driveway.

Now we have West Nile virus, a mosquito-borne disease that can cause encephalitis, a brain inflammation and other diseases. A friend’s brother died of Eastern Equine Encephalitis (EEE) disease. We vacinate for EEE, WEE and VEE.

This is the main reason NOT to have unregulate4d immigration from countries that have disease.
Surprise: After Illegal Immigration Wave, [drug resistant] Tuberculosis Plagues El Paso Hospital

….Earlier this summer when the unaccompanied minor crisis was at its peak (after really starting in October 2013) in Texas and Arizona, Border Patrol agents working inside processing facilities reported cases of Tuberculosis, scabies and other diseases being brought into the United States by unvaccinated illegal aliens. Warnings were issued by local communities about the impact these diseases could potentially have in the public school system where their children are educated….

Naturally, few in the media are making the connection between the most recent illegal immigration wave and Tuberculosis. According to the National Network for Immunization Information, Tuberculosis kills more people in the world than any other infection.

Back to draining swamps and Mosquitoes caused diseases.

      Mosquito-Borne Diseases
Mosquitoes cause more human suffering than any other organism — over one million people worldwide die from mosquito-borne diseases every year.

      Malaria
More than one million deaths and 300 – 500 million cases are still reported annually in the world…
A resurgence occurred during the 1960s and early 70s in the United States due to returning military personnel from Vietnam. Minor outbreaks of locally-acquired malaria occur sporadically in the United States, but have been quickly controlled by aggressive mosquito control measures. The influx of illegal immigrants in addition to returning tourists may provide for infrequent outbreaks in the future.

      Chikungunya

Chikungunya virus is a pathogen transmitted by mosquitoes, and has established itself in the Caribbean (approximately 350,000 suspected cases in the Western Hemisphere since December 2013). It has now resulted in 2 cases of locally-transmitted Chikungunya virus in Florida in July of 2014….
The name “Chikungunya” is attributed to the Kimakonde (a Mozambique dialect) word meaning “that which bends up”, which describes the primary symptom – excruciating joint pain. Although rarely fatal, the symptoms are debilitating and may persist for several weeks. There is no vaccine and primary treatment is limited to pain medication….

      Dengue
Dengue is a serious arboviral disease of the Americas, Asia and Africa. Although it has a low mortality, dengue has very uncomfortable symptoms and has become more serious, both in frequency and mortality, in recent years…. The spread of dengue throughout the world can be directly attributed to the proliferation and adaptation of these mosquitoes. Over the last 16 years dengue has become more common, for example; in south Texas 55 cases were reported in 1999 causing one death. More recently, Hawaii recorded 85 cases of dengue during 2001 and the Florida Keys reported over 20 cases in 2010

      Eastern Equine Encephalitis (EEE)

Eastern Equine Encephalitis (EEE) is spread to horses and humans by infected mosquitoes. It is among the most serious of a group of mosquito-borne arboviruses that can affect the central nervous system and cause severe complications and even death…. Symptoms may range from none at all to a mild flu-like illness with fever, headache, and sore throat. More serious infections of the central nervous system lead to a sudden fever and severe headache followed quickly by seizures and coma. About half of these patients die from the disease. Of those who survive, many suffer permanent brain damage and require lifetime institutional care. There is no specific treatment. A vaccine is available for horses, but not humans.

      St. Louis Encephalitis (SLE)

St. Louis Encephalitis (SLE) is transmitted from birds to man and other mammals… SLE is found throughout the United States, but most often along the Gulf of Mexico, especially Florida. Major SLE epidemics occurred in Florida in 1959, 1961, 1962, 1977, and 1990. The elderly and very young are more susceptible… Previously the last outbreak of SLE in Mississippi was in 1975 with over 300 reported cases. It was the first confirmed mosquito-borne virus in the United States in 2003…. In Louisiana in 2003 there was a fatal St Louis Encephalitis case previously listed as a West Nile caused death.

      LaCrosse Encephalitis (LAC)

LaCrosse encephalitis (LAC) is much less widespread than EEE or SLE, but approximately 90 cases occur per year occurs in all 13 states east of the Mississippi,…. There is no vaccine for LaCrosse encephalitis.

      Western Equine Encephalitis (WEE)

…. birds are the most important vertebrate hosts with small mammals playing a minor role. Unlike LAC it is nonspecific in humans and since 1964 fewer than 1000 cases have been reported As with EEE a vaccine is available for horses against WEE but not for humans. In Arizona 3 counties have been found with sentinel chicken flocks seroconverting to WEE.

      West Nile virus (WNV)
West Nile virus (WNV) emerged from its origins in 1937 in Africa (Uganda) into Europe, the Middle East, west and central Asia and associated islands. It is a Flavivirus (family Flaviviridae) with more than 70 identified viruses.

Ae. aegypti is more geographically confined to the southeastern United States. Traditional mosquito methods of truck-mounted and aerial sprays are ineffective in controlling these mosquitoes.

All of these Anit-US citizen actions makes sense if you are trying to ‘control’ the population and also trying to kill American Exceptionalism. D. Extremist Ideologies
      1. Introduction
      • As noted, an ideology is a set of political beliefs about the nature of people and society. People who are committed to an ideology seek not only to persuade but to recruit others to their belief. In U.S. history, there are many examples of extremist ideologies and movements. The colonists who sought to free themselves from British rule and the Confederate states who sought to secede from the Northern states are just two examples.

      2. Ideologies
      a. Nationalism – The policy of asserting that the interests of one’s own nation are separate from the interests of other nations or the common interest of all nations. Many nationalist groups take it a step further and believe that their national culture and interests are superior to any other national group.

      b. Supremacy – The belief that one’s race or ethnicity is superior to all others and should dominate society. Supremacy, as with racial supremacies in general, has frequently resulted in anti-Black and anti-Semitic violence.

      c. Separatism – Setting oneself or others apart based on culture, ethnicity, race, or religion.….

I try not to think of Obama, it just saddens me.

However, I do think he presents evidence for a change in the constitution.
That change being that the president should no longer be automatically the top Military person in the United States
and if the U.S. is the only so called super power left, it makes him the top military dog
in the world—that with in this case, no military training. no military bearing, no military common sense, no military sense of camaraderie, no military courage. no military etiquette, at least is suit is pressed. .
As one who reluctantly began serving in 1968, I would find it very difficult saluting him.

As to the subject at hand, the two reasons usually given for sea level rise are glacial melt and thermo-expansion of the oceans. So yes, there has been warming,of which sea level rise is an indicator— for sure since the depths of the little ice age. What I find incongruent is why there would be any sea level rise during the advent of the little ice age Any ideas?

Also, I do believe that there are some serious environmental concerns that are over shadowed by the AGW mania. A significant one is depletion of reserve water, particularly in aquifers.
One study reported that as much as 42% of sea level rise might be do to run off of water from aquifers Any Comments?.

  5. darrylb says:

I just read a comment from SMS, seems we concur.

  6. Lance says:

“Yes, But…. that was when natural cooling came before the un-natural warming that didn’t really happen because the real man made warming only started in 1998 according to NASA. So There. And everyone is going to drown because they vote Republican”. I’m just trying to beat the true believers to their punch line… 🙂 Saves a lot of time….

  7. gator69 says:

Thank God Florida is such a mountainous state, or it would be as flooded as Montana.

  8. splashhhh says:

Wouldn’t sea level rise create more swamp?

  9. Tel says:

The Everglades are an alluvial deposit, it automatically tracks sea level. When the deposit piles up in one place, the river turns and goes another way depositing silt somewhere else. Rivers don’t flow uphill, they always flow down to the ocean.

Imagine if you were a business requiring reasonably constant supply of goods.
      3 companies tender.

Company 1 says, yes we can supply the goods on a basically constant level so long as you say how much you want, but we can’t cope with big surges in immediate orders.

Company 2 says, yes, we are a little bit more expensive, we can give a constant, regular supply, but we can also supply extra on demand if you need it.

Company 3 says, stuffed if we know how much we can provide or when, but you will be told that you can feel good about yourself.
