New York Tramples The Second And Fourth Amendments

The US Constitution guarantees the right to bear arms, and the right to be safe from unreasonable search and seizure.

The NYS SAFE Act is billed as a necessary law to protect the public and keep guns out of the hands of the wrong people.

But Hamburg attorney Jim Tresmond says his client was notified by letter that his gun permit was suspended upon the recommendation of State Police, who learned the man is on anti-anxiety medication.

“Claiming that he had taken some psychotropic medications, and that he no longer could be eligible for the pistol permit,” Tresmond said.

The permit holder lives in Amherst and Tresmond accompanied the man as he turned in his seven handguns used for target-shooting to Amherst Police.

“A law-abiding, honest, hard working professional, who never had one wit of scandal associated with him, criminal or otherwise. And they took his guns away,” Tresmond said.

Tresmond is one of the attorneys already suing the state over passage of the SAFE ACT,which at the time was the toughest gun control law in the country.

Tresmond says his client once took a prescribed medication for his anxiety but he is not mentally ill. The Amherst man ended his prescription use within the last year.

“He is a law-abiding citizen, no record. He is a stellar member of the community, I would say. Not an ex-felon. He is one of the nicest young men I have met in a long time,” Tresmond said.

Officials confirmed state law permits the suspension of a gun permit before the permit holder even gets a chance to state their case.

Obama and Biden keep saying that they have no plans to confiscate guns, while they are already doing it.

    Tell me how the hell does the State know this guys medical record?

      Steve C, have you been to the doctors office lately? everythings done on a computer!! Doc prescribes meds + patient is a registered gun owner = this person needs to turn in his guns

        My comment was rhetorical in nature. Yes, I am at physician’s offices everyday. One of my hats I wear involves educating physicians. We have started to accelerate even faster on this slippery slope!

    Under the new fascist Obama Care the Federal Government will know every detail of your existence. Although the NRA got an exclusion to your Dr. asking if you own a gun.

    This is what happens when you let the government (federal or state) unilaterally modify the Second Amendment without going through the amending process as described in the U.S. Constitution. If the courts allow these unconstitutional laws to stand, what happens next? Will we see states try to modify our First Amendment rights by forcing citizens to obtain free speech licenses?

    The NYS Safe Act described above is very dangerous. The state could eventually broaden the definition of “mentally unfit” to include many categories of prescription drug users, heavy alcohol users, marijuana smokers, libertarians, Sept. 11 Truthers, Tea Party members and anti-government activists. Of course, the real intention of the law has always been gun confiscation. It’s a backdoor attempt to disarm law-abiding gun owners.
