Police State Update : Sexual Assault For Not Coming To A Complete Stop

The incident began January 2, 2013 after David Eckert finished shopping at the Wal-Mart in Deming.  According to a federal lawsuit, Eckert didn’t make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.

Eckert’s attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks.  Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity.  While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.

The lawsuit claims that Deming Police tried taking Eckert to an emergency room in Deming, but a doctor there refused to perform the anal cavity search citing it was “unethical.”

But physicians at the Gila Regional Medical Center in Silver City agreed to perform the procedure and a few hours later, Eckert was admitted.

What Happened

While there, Eckert was subjected to repeated and humiliating forced medical procedures.  A review of Eckert’s medical records, which he released to KOB, and details in the lawsuit show the following happened:

1. Eckert’s abdominal area was x-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert’s anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert’s anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert’s anus to insert an enema.  Eckert was forced to defecate in front of doctors and police officers.  Eckert watched as doctors searched his stool.  No narcotics were found.

5. Doctors penetrated Eckert’s anus to insert an enema a second time.  Eckert was forced to defecate in front of doctors and police officers.  Eckert watched as doctors searched his stool.  No narcotics were found.

6. Doctors penetrated Eckert’s anus to insert an enema a third time.  Eckert was forced to defecate in front of doctors and police officers.  Eckert watched as doctors searched his stool.  No narcotics were found.

7. Doctors then x-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert’s anus, rectum, colon, and large intestines.  No narcotics were found.

Throughout this ordeal, Eckert protested and never gave doctors at the Gila Regional Medical Center consent to perform any of these medical procedures.

“If the officers in Hidalgo County and the City of Deming are seeking warrants for anal cavity searches based on how they’re standing and the warrant allows doctors at the Gila Hospital of Horrors to go in and do enemas and colonoscopies without consent, then anyone can be seized and that’s why the public needs to know about this,” Kennedy said.

  1. This is why we have a second amendment. That man should have used lethal force to defend himself.

    Allowing yourself yo be maimed, raped or killed by law enforcement is not patriotism nor a civil obligation.

      Yeah, that would have turned out well. The SCOTUS is responsible for allowing LEO’s all sorts of strip searches. The SCOTUS also has basically allowed police to assault Citizens and if you refuse to go along they will maim and kill you with impunity. There is no self defense allowed in such situations. LEO’s are our overlords. That needs to change/be changed.

      Remember this was all about money when you distill it to its essence. Find some drugs, confiscate the car and cash. Happens every day across America, and often no charges are filed. They’ll just confiscate and divvy up the spoils.

    I hope he gets ten million dollars from the citizens of that county. Big money is the only language that will put a stop to the growing incidence of police abuse. When citizens see their taxes go up to pay for such lawsuits then it becomes a campaign issue to change local governments.

  6. Clenching his buttocks in front of police officers! Everyone knows you can’t do that. Those peace officers exercised restraint. They could have shot him dead on suspicion he was holding a gun there.

    This bitter clencher should stop being so anal about the little inconvenience. He got extremely lucky.

    I’d like to see the affidavit given to justify that warrant. It must have been more than just, “he clenched his buttocks during a routine traffic stop.”

    Did the guy have a record of drug offenses? Did he have drug paraphernalia in the car? Did a drug dog “alert” on him?

    There has to have been something more than what Eckert’s attorney told station KOB. Otherwise, every hemorrhoid sufferer could get a free colonoscopy just by running a stop sign.

      Let’s assume (against any given evidence, but merely as a possibility) that the guy is a former convicted drug felon who smelled like marijuana. After being X-rayed, fingered up his anus twice, given three enemas and then x-rayed again — all of which turned up negative! — what possible justification can you think of for having a camera shoved up him? Seriously, if Moses came to the hospital with a stone table saying “Check this guy’s butt!” wouldn’t the proper response to him be, “Hey we already did (literally) seven different times! Trust me, he’s clean!”

      The Doctors should be removed from practice and jailed. The police should be removed from the force and jailed.

    After this story everyone in Deming is going to be clenching their buttocks when they get pulled over!

    Here’s a neat tidbit. If the stopsign was improperly posted on private property (wrong height, size, etc), the sign isn’t legally binding and the original grounds for the stop are gone in the first place.
    Depending on the state, stopsigns on private property aren’t valid period.

  18. When I was on a jury, we found a man guilty of rape for doing a lot less than these doctors did. I also have to point out that after they raped his body, they charged him for it!

    He should make it his life’s work to garner the largest damages payout in a rape case in human history, get all the medical professionals involved barred from ever doing as much as applying a band-aid again and then get on the case of all the cops and the judge who started this until their own mothers won’t speak to them again.

    I would consider this required reading for all the sheeple out there. Time to wake up! We are so far from the Constitution now that even science fiction books and movies can’t describe it.
