Ten Year Old Boulder Kid Sues The State

Boulder Youths Sue Colorado For Global Warming

10-year-old Xiuhtezcatl Martinez, 11-year-old Haiden Inskeep and 18-year-old Cecelia Kluding-Rodriguez are joined by WildEarth Guardians, an environmental activist and protection organization of which Martinez is a member, to sue the state as a concerted effort to establish the “atmosphere as a public trust resource” and for damages due to health issues that have surface for the three youths due to a failure to protect the natural environment, according the lawsuit filed by their attorneys.

Roske-Martinez says that part of the reason she is so vested in environmental causes is that she had friends who lost their homes in the Fourmile Canyon Fire, the most destructive fire in Colorado history.

Apparently Colorado never had fires before people started building their suburban homes in the middle of the forest.

I hope these kids can survive the heat. It is 38F (3C) in Boulder this afternoon.

Coming up next: Climate Class Action…for the as yet unborn class of 2035 that is…

  2. papertiger says:

Omni, I like that idea. If the unborn can sue then the Democratic party as a whole will be liquidated to pay for all the aborted peoples of America.

I don’t see any way these kids can possibly win. They’d have to be able to prove that the wildfires were caused by actions of the state…yeah right.

They’d have an easier time suing the city of Boulder for permitting so many toxic aerosol releases on 04/20. At least that is likely traceable/attributable.

I would think that one would have a better chance of suing for lost income due to a clear scam perpetrated by environmental groups. The damages in this case are much more easily documented. I think African states could sue the USA and other UN countries for the 300,000 people that are estimated to already have starved in Africa because of diverting food into car fuel. AND not to mention the mercury exposure that was perpetrated by the crooked scams. All one has to do is show that elevated levels exist after squigglies have been installed. Then any disease state from ADHD to cancer could be attributed to that, since mercury is a carcinogen and a neuropoison. I see a potential gold mine here.

I read about this a week ago–Environmental groups are bringing law suits in many states –they are in alliance with the EPA

The global warming war moves into the courts. Leftists have always used the courts to force their will upon people. Abortion is the prime example.

      • Scott says:

Watch out, the CAGW believers (in general) get very touchy when abortion gets brought up. There’s a reason that so many people avoid discussing it in depth like it’s the plague.

      • bubbagyro says:

Leftists, starting in earnest with Hitler, pushed eugenics as a way of getting rid of “useless eaters”. Margaret Sanger, founder of Planned Parenthood, picked up on this, advocating abortion and sterilization of minorities and other “defectives”. Leftists like Joe Kennedy, pushed this philosophy of death, and this tone continued through his clan. SO cAGW’s ultimate solution (I won’t say the final one, if you get my drift), is the complete envirofascist one, typified by Ehrlich: Forced reduction of world population to 500 million (of the “select”). SO you can see why they don’t want people to connect the dots, at least not in public forums.

        [Shhhh!]

  5. Amino Acids in Meteorites says:

    Is Boulder Berkeley Jr.?

  6. Andy Weiss says:

Now fires qualify as “climate change”. What about auto accidents and dog bites?

  7. mohatdebos says:

Don’t sell these crazy law suits short. The U.S. Supreme Court already ruled that carbon is a pollutant that EPA could regulate. This is simply the next, logical step. As someone noted above, the criminals at EPA are probably behind these law suits also.

  8. Al Gored says:

There’s at least an IPPC worthy ‘trend’ here. Second case of exploiting children I have read about in the past week plus a UN report on how the Planetary Fever will be worse for kids. They’ve being playing this angle for a long time but it looks to be ramping up. Will be lots of Climate Youth rallies this summer. Heil Hansen.

  9. Jim Cole says:

Let’s remember – WildEarth Guardians is just a repackage of Earth First!, the eco-terrorist group convicted of spiking trees in logging areas, torching the summit building in the Vail ski area, and numerous other criminal “actions”.

I really feel sorry for these kids – one day, they’ll wake up and realize how their folks used them as cheap political pawns in a manufactured crisis. I hope the parents live long enough to witness the natural evolution of their offspring into thinking adults who can spot BS on sight.

Yikes! Science education is failing to teach skepticism, especially of conventional, “consensus”, thoughts.

  10. RobbCab says:

What worries me about this trend is how vigoriusly these cases will be defended by the government.

We already know the Federal Government is refusing to defend the constitutionality of certain laws based on personal beliefs.

What would stop the state of CO from “throwing” a case like this?
