SURPRISE, Ariz. (CBS Cleveland) — Arizona authorities charge a man for driving under the influence despite him blowing a .000 on a breathalyzer test.
KNXV-TV reports that 64-year-old Jessie Thornton – a native of Ohio – was recently pulled over by Surprise police after he recently left an LA Fitness gym. Thornton then says the officer accused him of driving drunk.
“He walked up and he said ‘I can tell you’re driving DUI by looking in your eyes,’” Thornton told KNXV.
Thornton was then given a sobriety test.
“I take my glasses off and he says, ‘You’ve got bloodshot eyes.’ I said, ‘I’ve been swimming at LA Fitness,’ and he says, ‘I think you’re DUI,’” said Thornton. “He goes, ‘Well we’re going to do a sobriety test.’ I said, ‘OK, but I got bad knees and a bad hip with surgery in two days.’”
Despite the DUI charge being dropped, his car was impounded. He is now suing the City of Surprise for half a million dollars.
“This is a case of D-W-B, driving while black,” Marc Victor, Thornton’s attorney, told KNXV.
The Surprise Police Department did not comment on the case

That cop needs to experience DWU .. driving while unemployed as he is leaving town.
Rightly named town. “Didn’t do anything wrong?” “We’ll take your car anyway.” ” “Surprise!”
Maybe the cop was basing his judgement on an adjusted reading. (If they’re suspended from the force, they should consider becoming climatologists.)
Obviously the cop has never been to a swimming pool or he would have understood the man, it’s a fact that chlorine can irritate your eyes if you spend to much time in the pool.
I used to get pulled over at least once per week when I was younger. My everyday driver was a 1969 GS 400 convertible, and if I was out on a weekend night (every weekend back then) I could count on being pulled over at least once. On more than one occassion I was told to get out of town and not to return, after they turned up no offenses.
I don’t mind being profiled, but I do mind being hassled.
Well it might be DWB or might not. It could also simply that time of the month, when cops are in their ticket quota olympics.
Call it DWCABFTQTRFFTCB … driving while cops are busy filling ticket quotas to raise funds for the city budget
