“The Constitution is NOT an instrument for the government to restrain the people, it is an instrument for the people to restrain the government — lest it come to dominate our lives and interests.”

Damn straight.
How can the restrainee have become the testrainor? Through permanent crises. AGW being their last invention.
NO, through the idea of “justice”, papering over the real, unforgiving desire for revenge, and revenge alone, as acceptable. That’s why “It’s Bush’s fault” rings so “true” to the Insane Left. All those–Blacks, Muslims, Latinos, Malthusian environmentalists; name your poison–who are essentially still living in the past, clinging to their sense of injustice in the system (never thinking that even White Christians experience much the same obstacles to their individual ambitions, from the ever-present intransigence of entrenched powers, not racism nor classism nor sexism nor anything else but simple “me first”–the eternal obstacles to every individual). What is behind all this is the ascendance of the various false dogmas embraced by various groups into raw confrontation–open war, of a sort–and, most fundamentally, and simply, the endemic false belief in “an eye for an eye” over the spiritual (and thus overarching) truth of “love thy fellow man, who was made just as you are made” and “do unto others as you would have them do unto you” (the real Golden Rule). Many know better than what they are doing or are putting up with, but they have been suborned, misdirected and perverted by the illusion of political power, to ignore their true moral understanding, which cannot be encompassed by any political force. And that is the key: To deny the substitution of naked force for true morality, and to see one another as individuals, all made in the same way but divided, before the beginning of known history, into competing tribes (which is an animal grouping, not an essentially human one that emphasizes our raised heritage above mere animals).
