    I my part of gods own we are having a run of +30 degree (C) days and it is as dry as a Hindi’s gym boot. No decent rain since June and the stock are running short of feed. Pattern very similar to 1985-86.

          Sometimes……, well, lets just say that sometimes I get rather radical right wing fantasies about direct action and lets leave it at that.

          First they tried to come after my firearms. Then they came to dictate how my septic tank and laterals must be set up. Then they came to dictate how much water my toilet can use. Then they came for my incandescent light bulbs. Then they have worked so very hard to make my electric and heating costs go up. Then they made my health insurance rates sky rocket and as I write this my next grand baby that is obviously ready to come into this world is being made to wait despite the fact that her mother is so swollen on her right side with pitting edema that she can hardly move. All because of the new insurance rules. And then they say they their wanting to come after my Christmas lights. And now they want to take my Blue Cheese away and are instituting new regulations to bring the price of gasoline up again?

          BTW less than 1 year after making a major change in the hours of service rules the US DOT rescinded it as of the 1st of December. January of this year they instituted the 168 hour rule. The rule required that a driver could only reset his/her 70 hours of on duty time to zero hours used by taking a 34 hour break no sooner than 168 hours after the last 34 hour break began. It further required that the 34 hour reset time must include two periods of 01:00 to 05:00. Well the dumbasses didn’t figure on something any experienced truck driver could have told them. By doing that they were ensuring that more drivers would be driving during the high traffic hours a fewer during the lower traffic hours at night. Increased congestion = increased accidents. It’s just that simple and any one with a lick of common sense would have known that.

          Yes I do have fantasies sometimes.

          WTF! They are idiots. All the 34 hr break was supposed to do was make sure you got a breather and were well rested instead of driving back to back for weeks on end without a decent break.

          Now they are regimenting exactly WHEN a driver can drive and when he can not? What the heck does that do to the team drivers?

          What next national schedulers for the entire US fleet…
          (I should not give them ideas.)

          Well Gail this one will get you to. When they came out with the 168 hour rule they also instituted another rule requiring a 1/2 hour kindergarten nap time. A driver must log a .5 hour break between the 3rd and 8th duty hour and cannot work over 8 hours without taking that break. That one still remains in effect. DOT wants truck drivers to be more like government workers it seems.

          I started my road to discovering just how corrupt the US government is with the targeting of our food supply. The MAD SHEEP saga was one of the trial balloons to see if the USDA could get away with terrorizing farmers and US citizens.

          On April 26, the United States Food and Drug Administration (FDA) submitted its response to a lawsuit filed earlier this year by the Farm-to-Consumer Legal Defense Fund (FTCLDF). The FTCLDF lawsuit claims that the federal regulations (21 CFR 1240.61 and 21 CFR 131.110) banning raw milk for human consumption in interstate commerce are unconstitutional and outside of FDA’s statutory authority as applied to FTCLDF’s members and the named individual plaintiffs in the suit. In its answer to the complaint, FDA made its position on the issue of ‘freedom of food choice’ a part of the public record. FTCLDF has until June 14 to file a reply to FDA’s response.

          The agency has long opposed ‘freedom of food choice’ but its response to the FTCLDF complaint represents FDA’s strongest public statement yet on the freedom to obtain and consume the foods of one’s choice.

          FDA’s Views on Freedom of Choice

          Here are some of FDA’s views expressed in its response on ‘freedom of food choice’ in general and on the right to obtain and consume raw milk in particular:

          “Plaintiffs’ assertion of a new ‘fundamental right’ to produce, obtain, and consume unpasteurized milk lacks any support in law.” [p. 4] [Note the view is unless the government allows it, ‘the right’ is banned. This is the exact opposite of what the Constitution say.]

          “It is within HHS’s authority . . . to institute an intrastate ban [on unpasteurized milk] as well.” [p. 6]

          “Plaintiffs’ assertion of a new ‘fundamental right’ under substantive due process to produce, obtain, and consume unpasteurized milk lacks any support in law.” [p.17]

          “There is no absolute right to consume or feed children any particular food.” [p. 25]

          “There is no ‘deeply rooted’ historical tradition of unfettered access to foods of all kinds.” [p. 26]

          “Plaintiffs’ assertion of a ‘fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families’ is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish.” [p. 26] [In other words the government OWNS us]

          FDA’s brief goes on to state that “even if such a right did exist, it would not render FDA’s regulations unconstitutional because prohibiting the interstate sale and distribution of unpasteurized milk promotes bodily and physical health.” [p. 27]

          “There is no fundamental right to freedom of contract.” [p. 27]

          That is a very revealing statement by the US government. There were others that showed up during the ‘Food Fight’

          The MAD SHEEP SAGA
          USDA asserts in Court, “The farmers have no rights.” That is from a quick Time Line from the book “Mad Sheep” by Linda Faillace.

          Linda Faillace wrote a more fleshed out time line HERE.

          Of particular note is this:

          In 1990 Linda and Larry Faillace and their 3 children moved to England from the US after Larry completed his PhD in animal physiology. Larry was offered a position at the University Of Nottingham School Of Agriculture and they jumped at the chance to live and work overseas. Linda worked at the University as secretary to Professor Lamming, a well-known researcher in the field of Mad Cow disease. Linda learned a great deal about the disease and planned to continue researching it upon their return to America. [In other words these people were experts in Mad Cow disease.]

          …..Linda heard that there was more information at the USDA and used the Freedom of Information Act (FOIA) to request data from the USDA. Two weeks after the request, the FOIA revealed four hundred negative results on sheep, including additional negative tests on the four sheep that Rubenstein and the USDA claimed were positive!

          Larry and Linda spent hours in Davis’s conference room poring over the 1,116 pages of documents and learned:

          * In June of 1999 Mr. Freeman gave sixty-five animals (including the infamous four) from his flock of more than 250 to the USDA.

          * If American cattle are negative by histopathology, nothing else is done, but when European sheep test negative, the USDA goes to extraordinary measures to keep testing, attempting to find a positive, and if all else fails, the USDA will concoct positive test results in order to justify their actions.

          * From the four hundred test results they ascertained that the USDA killed Mr. Freeman’s lambs in June of 1999 and sent the brains to NVSL, where they were tested using histopathology and IHC. NVSL tested tissue from the exact same area of the brain that Rubenstein did. All animals tested negative.

          * The third eyelids were extracted and sent to Dr. Katharine O’Rourke, who tested all of them in August of 1999. Every single one was negative.

          * When all this testing was completed, the remaining tissue was then thrown in a freezer where it began to autolyze (enzymes within the cells begin the process of self-digestion).

          * Finally, when the Faillaces refused to give in to the USDA’s demands to hand over the sheep, they sent the freezer-burned samples (which were now a year old) to Rubenstein, who contrived four false positives using extremely shoddy testing [Using a new ‘method’] and then claimed he could not run any further tests because he had disposed of any remaining tissue samples.

          Finally years later the last of the story is told. The Sheep killed and the straws of frozen ram semen destroyed was all for nothing. The sheep did not have the disease AND THE USDA KNEW IT! USDA Treachery Proved!

          Cindi Henshaw was actually on line posting to the NoNAIS site during her house arrest and later nearby members of the board went over to investigate the story. Again the government was so far out of line it was jaw dropping.

          Here are some snippets I copied at the time.

          The behavior and health of the pigs was not consist with the disease. [The sows abort and pigglets are unhealthy and listless. The Henshaw pigglets were too fast for the Agents to catch.] Pigs were NOT listed on the law cited.

          Gladstone, Virginia: “I am sitting here at 1:00 am, and trying to figure out what has happened to our little farm. Last Tuesday morning at 5:30 am a Game Warden arrested my husband on a Class 2 Misdemeanor for having a mammalian shooting enclosure without a permit. That was followed by agents from the USDA swooping in (9 different vehicles) and beginning the slaughter of our hogs. It is almost one week later, and it is still going on. We have 24 hour armed surveillance, we are not allowed on our preserve, we are not allowed to do our own testing, and they have killed 2 of our pet hogs that we had in a totally separate pen [separately deeded property not on warrant]. We are in shock. My husband has had a hunting club for 11 years and out of the blue, our lives have been taken over and our rights taken away. WE are being treated like drug dealers by the agents. The Game Wardens are stunned at the way this all happened and have said they have never seen anything like this. Even one of the USDA’s agents from Ohio said he has never witnessed anything like what is going on here. Any advise?” Cindi Henshaw

          Just to say several us from Amherst County went down to the Henshaw’s yesterday evening(October 2,2006) to give our support. We can confirm Cindi’s comments in message 83 about an agent coming to the door. We heard him tell Danny about the small footprints, leaving a bag of corn for him to feed the hogs and that they would be back.
          Early this morning a friend and I rode to the Henshaw’s. We were there when a game warden came in and drove to the reserve gate. He turned around went back down the driveway.
          I walked out to the gate for the reserve just to see for myself. It had a chain lock on it. If it is a quarantined area why didn’t I see any quarantine sign, do not enter sign, warning tape, etc.?
          Very shortly the game warden and a man in a truck with U.S. government plates came up the drive and to the reserve gate. They stayed very briefly and left.
          The holding pen for the 2 pet pegs was very clearly not connected to the reserve.
          The NAIS and Congress Robert Goodlatte’s support of it provoked a group of us to circulate a petition to get me on the ballot for Virginia’s 6th Congressional district. Those of us involved are doing everything we can to use the campaign forum to educate on the perils of NAIS.

          I am a retired magistrate and am having a real hard time getting my head around why Danny was arrested to begin with. Rather than a warrant a summons could have been issued which would have given him a court date and not required his arrest. Also, second class misdemeanors can be permitted (sign for with promise to appear on a certain date) or not permitted which require an arrest and being taken to the magistrate for a bond hearing. What was said to the magistrate to make this type of warrant be issued is very perplexing to me

          This is very important. The Government Authorities hauled off the bodies of the hogs, who were a ‘health risk’ leaving a large bloody trail going down the road.

          Our State Vet in Vermont sent me the link for the APHIS Pseudorabies Eradication State–Federal–Industry Program Standards.
          Two points that I can see that VA did not follow.
          *Official pseudorabies herd-cleanup plan: A written plan to eliminate pseudorabies virus from a swine herd. This plan is (1) developed by an official pseudorabies epidemiologist in consultation with the herd owner and his or her veterinary practitioner, when applicable; (2) mutually acceptable to those parties; and (3) approved by the State animal health official.
          [HA! They failed that one]
          *Have undergone a 30-day depopulation with appropriate cleaning and disinfection. [Disinfection? What’s that?]

          The USDA is STILL here on our property. After 3+ months they have not been able to kill/catch the 100 pigs on our 100 acres. Mind you, this is our governments’ finest. They have sent special trained sharpshooters in, used professional catch pens and had over three months…and are not able to get the job done…

          So, just for posterity…the USDA and their cohorts took over 7 months to end their command of our personal property. We, of course, must continue to pay our personal property taxes on land that we had no rights or access to….

          Then there was the trial with an idiot lawyer named Norman.

          ….The person that Dan had to talk to after, really had an ego attitude for sure. We noticed it when we were in the courtroom. Danny came out with his blood pressure about to explode.. This gal, I guess, treated Dan like a common criminal asking all kinds of personal questions and telling him he would have to be drug tested, go for counseling, report to her every two weeks and all kinds of unnecessary things, which in fact did not apply to his case. According to the Judge, all he had to do was arrange payment of fines by 01 June, 2007….

          While we were talking to Norman, he pointed out the laws that were sited on the original warrant. ( there were several quoted on the original papers) and Norman found, after a great deal of study, there was no law at all that pertained to this case, especially how it was carried out with no notice or warning to correct the problem, if in fact one existed. Basically the bottom line is Danny was convicted on laws that do not even exist. SO MUCH FOR JUSTICE….
          My personal thought is this: The Powers to be, can take any written law and mold it to suit their own purpose, especially when they know that the way this whole event was carried out, was WRONG. Even the Deputies outside the Courtroom (Sheriffs) agreed that it was all wrong and should have been handled a lot different, too late for that HUH?…

          I do not save the specifics but someone on the board had papers on the case of interest to the government so their car was broken into and the papers stolen. Also someone else who had gone to see the Henshaws reported the Agents left the place a mess leaving food wrapers and toliet paper and human feces.

          YUP, this was ALL about health and safety….

    ….about 300 cars were stuck on Highways 330 and 18 in Big Bear as snow began piling up from the storm, said California Highway Patrol Officer Marcelo Llerena. Between 150 and 200 cars were towed off the road and will have be picked up later by their owners….

    Some here who know me a bit might ask, “why did the market anarchist decided to try to defend Gov. Moonbeam?” That is a fair question, so I’ll attempt an answer.

    Gov. Moonbeam is a hopeless dolt, but you have to compare him to other politicians to be fair. It does no good to compare him to regular citizens (as doltish as they may be). But Moonbeam’s greatest fault might be summed up by the following Mencken quote:
